First Kick Football Nursery Terms and Conditions
1. Definitions
1.1 “The guardian” is the person who attends The Session with The Player and is
authorised by The Parent to do so.
1.2 “The Parent” means the parent or legal guardian who will be responsible for the
payment of The Fees and who is the contracting party to this contract.
1.3 “First Kick Football”, “First Kick Mini Kickers” or “First Kick” means First Kick CIC, or licensed franchisees of First Kick CIC with whom The Parent enters into an agreement.
1.4 “The Sessions” are the First Kick Football classes you are attending or enrolling on to.
1.5 “The Enrolment Form” refers to the digital form on firstkick.co.uk or firstkickminikickers.co.uk, relating to enrolling, or reenrolling The Player on The Sessions.
1.6 “The Fee” means the monetary cost for The Sessions paid to First Kick Football.
1.7 “The Coach” means the individual(s) contracted by First Kick Football to run The Sessions. Whilst every effort is made to maintain the consistency of The Coach at The
Sessions, First Kick Football unreservedly retain the right to change The Coach where necessary.
1.8 “The Stadium” means the room (or portion thereof) where The Sessions take place. Whilst every effort is made to maintain the consistency of The Stadium’s location for The
Sessions, First Kick Football unreservedly retain the right to change The Stadium’s location.
1.9 “The Player” means the child attending The Sessions, whose details are specified
By The Parent on The Enrolment Form.
1.10 “The Shop” means the online store ‘firstkick.co.uk/shop’ or the platform to
purchase items when initially paying The Fee online.
1.11 “T’s & C’s” means the terms and conditions set out in this document and any
special terms set out by First Kick Football.
1.12 “DBF Award” means the Development Beyond Football award given to children in exchange for a completed Sticker Chart.
1.13 “Blue stickers” means the 37mm blue circular First Kick Football logo stickers issued at the end of the majority of The Sessions.
1. 14 “Themed Stickers’ means the 64mm circular stickers that relate to a specific theme applied to The Sessions that day.
1.15 “Sticker Chart” means the paper chart with 48 sticker watermarks that when filled can be exchanged for a DBF award.
2. Acceptance of T’s & Cs
2.1 All agreements related to The Sessions by First Kick Football to The Player are subject to
these T’s & C’s.
2.2 Variations or additions to the T’s & C’s shall be deemed to be accepted if The Parent
is given 30 days-notice in writing or verbally by First Kick Football.
2.3 The T’s & C’s shall be deemed to have been accepted by The Parent upon payment
of The Fee by or on behalf of The Parent. Payment by The Guardian shall be deemed
to have been made on behalf of The Parent.
2.4 The Parent or The Guardian agrees to keep the content of First Kick Football sessions and the First Kick Football training program confidential, and not use or copy any aspect of the First Kick Football program me directly or indirectly for commercial purposes. The Parent and The Guardian agree not to directly or indirectly manage, operate or assist in the organisation of any business that competes with First Kick Football while The Player is
enrolled at First Kick Football and for a period of two (2) years afterwards.
2.5 Classes will run for 48 weeks of the year with holidays specified on

3. Fee and Payment
3.1 The Parent shall pay The Fee in its entirety prior to The Player commencing The
Sessions unless agreed by First Kick Football.
3.2 The Fee is non-refundable except with the prior written agreement of First Kick Football.
3.3 If The Session is cancelled as a result of an ‘Act of God’ (e.g disruption resulting
From extreme weather conditions), strikes, terrorist activity, or where the local authority
or public guidance advise that travel should not be commenced unless absolutely
necessary, then no refunds will be given, and it will not be possible to defer The
Session during the affected period.
3.4 The Fee will be £29.99 per calendar month to reserve The Players place in that
class, regardless of attendance to The Sessions by The Player or the number of
sessions hosted in that calendar month, by recurring card payment.
3.5 In such an event as 4.3, it is The Parent’s responsibility to cancel their recurring card payment
after ensuring The Fees are up to date.
3.6 In the event that a First Kick Football Franchise, Stadium or class is closed, First Kick Football will endeavour to offer an alternate class, Stadium, or Franchise with minimal disruption to their front-end service offered to The Parent.
4. Cancellation
4.1 First Kick Football may cancel this contract at any time, before The Player commences The Sessions for any reason whatsoever. First Kick Football shall not be liable for any loss or damage whatsoever arising for such cancellation.
4.2 In the event of cancellation by First Kick Football prior to the commencement of The
Sessions by The Player, First Kick Football will refund The Fee for the remaining calendar
month.
4.3 For The Parent to cancel The Sessions, they must complete the form in the Parent Portal. If the subscription payment is cancelled via the bank without
informing First Kick Football, that calendar month’s Fee will still be owed to First Kick Football.
4.4 In the event of cancellation by The Parent, four-weeks’ notice of cancellation from
the date of their last Fee payment must be given.
4.5 In the event of cancellation by The Parent, if less than one calendar months
Remains until The Parent’s next scheduled payment, no refund will be issued.
5. The Parent’s Responsibility
5.1 The Parent warrants and represents:
5.1.1 The information set out in The Enrolment for is accurate in all aspects and The
Parent will notify First Kick Football of any changes in such information as soon as practicable.
5.1.2 When attending The Sessions, neither The Player nor The Guardian will be
suffering from any illness, disease, or anything similar thereto.
5.2 The Parent acknowledges and agrees that The Player shall be deemed to be under
direction, care and control of The Guardian throughout The Sessions and The Guardian
shall be responsible for the welfare and conduct of The Player throughout The
Sessions and whilst The Player is at The Stadium.
5.3 The Parent shall indemnify and keep indemnified First Kick Football against all loss
(including loss of profit), liability, costs and expenses, which First Kick Football shall incur directly or
indirectly as a consequence of any action or inaction of The Parent, The Guardian or The Player.
6. Discipline
6.1 In the event that First Kick Football determines the behaviour of The Player and/or The Guardian to be unacceptable, First Kick Football shall be entitled to exclude The Player and The Guardian (or either of them) from The Sessions and The Stadium permanently or for such a period that First Kick Football shall (in its entire discretion) determine.
6.2 The Standard of behaviour which is to be regarded as unacceptable at The Sessions
or at The Stadium shall be determined by First Kick Football.
7. Exclusion of Liability
7.1 Except in the case of fraud, First Kick Football, its Coaches, servants, employees, or agents accept no responsibility under any circumstances for any loss (consequential or
otherwise), damage, expense or delay, suffered or incurred by The Parent, The Player
or any other party arising directly or indirectly or in any way connected with the
attendance of The Player at The Sessions or The Stadium, or any other act or omission
on the part of First Kick Football or any of its coaches, employees or agents. Even if such act or omission is negligent.
7.2 The Parent agrees (for and on behalf of The Parent/The Guardian/The Player) that
any claim by The Parent or The player against First Kick Football or any coach, employee or agent of First Kick Football must be brought within 30 days of the event which gave rise to such a claim. Any claim thereafter shall be time barred.
7.3 The Parent acknowledges, warrants and undertakes (for and on behalf of The
Parent/The Guardian/The Player) that the maximum aggregate liability by First Kick Football To The Parent and or The Player under the T’s & C’s shall not exceed The Fee.
7.4 All warranties and conditions whether implied by statute or otherwise are
Excluded from this contract provided that nothing in this contract shall restrict or exclude
liability for death or personal injury caused by the negligence of First Kick Football, its coaches, servants, employees or agents or affects the statutory rights of The Parent or The Player.
8. The Shop
8.1 Any purchases made via First Kick Football.co.uk/shop will be subject
To the terms and policies available on the site.
9. Gifts
9.1 Any items given to The player throughout the year are a gift from First Kick Football. They are not included as a purchase within The Fee and can not be exchanged for any monetary value. These items are given at the discretion of First Kick Football.
9.2 All items will be distributed to each Stadium the week. If for any reason The Player
Or The Parent is unable to attend on the day the gift is given out, the item will be held at
the stadium for a further 1 week.
9.3 If The Player’s gift is unclaimed after 2 calendar weeks, it will be returned to the central Distribution centre – First Kick Football, 9A Hennel Lane, Preston, PR5 4LA.
9.4 If The Parent wishes to claim the gift beyond the 2 weeks, they must inform
First Kick Football via email, then the item will be posted to their registered address with all postage fees incurred by The Parent.
10. DBF AWARDS
10.1 Each child is entitled to one sticker per attended Session.
10. 2 Only the designated sticker for that day will be given by The Coach to The Player. The designated sticker is determined by First Kick Football.
10. 3 No replacement Blue Stickers will be issued if the sticker or Sticker Chart is lost unless photo evidence of said collection can be provided.
10.4 In the event of a missed Themed Session, loss of Sticker Chart or individual Themed Stickers, Themed Stickers can be replaced.
10.5 No accompanying family/friends are entitled to a Sticker.
10.6 Once all watermarks on the Sticker Chart have been filled with the corresponding Blue Stickers and Themed Stickers, the reverse of the Sticker Chart must be completed by The Parent and handed to The Coach who will in turn process the order. The Parent will be asked to confirm the order prior to completion. The DBF Award will be attempted to be presented at the following class, subject to The Player’s/The Coach’s attendance, and the order being delivered to The Coach in time.
10.7 The DBF Award is not included as a purchase within The Fee and can not be exchanged for any monetary value. It is given at the discretion of First Kick Football and can be removed as a prize at any time.
10. 8 Completed Sticker Charts will not be accepted if The Player has attended The Sessions for less than 1 calendar year.
10. General
10.1 Any notices to be sent by First Kick Football to The Parent shall be sent by email or SMS text message to the information given on The Enrolment Form and shall be deemed to have been received by the addressee within one hour of sending.
10.2 Any notices to be sent by The Parent or The Guardian shall be sent by email or
SMS text message and shall be deemed to have been received by First Kick Football once
Responded to.
10.3 The Failure by either party to enforce at any time or for any period any or more of
the obligations arising under these T’s & C’s shall not be a waiver of them or of the right
at any time subsequently to enforce all the obligations under these T’s & C’s.
10.4 By agreeing to these T’s & C’s, The Parent grants media consent for First Kick Football, its servants, coaches, employees or agents to capture photographic images or video of The Session which may include The Player to the be posted on First Kick Football Social media Pages or First Kick Football website.
10.5 These T’s & C’s constitute that the entire agreement between the parties hereto
and supersede all prior agreements and understanding between the parties. It is
agreed that no statement promised or inducement, whether written or orally agreed to have been made by either party which is now contained herein shall be binding or form part of this agreement.
